Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and SmokeVPN ("SmokeVPN", "we", "us", "our"). By creating an account or using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account or use the service.

1. Who may use SmokeVPN

You must be at least 18 years old and legally able to enter into this agreement. You must not use the service where doing so is prohibited by the laws that apply to you.

2. The service

SmokeVPN is a privacy-focused, logless VPN and proxy service. We route your internet traffic through servers we operate so that the sites you visit see one of our servers instead of you. We believe privacy is a fundamental human right, and we build the service to hold as little data about you as possible (see our Privacy Policy).

3. Your account

Your 16-digit account number is your only credential. Anyone who has it can use your account, and it cannot be recovered if you lose it. You are responsible for keeping it safe and for all activity that occurs under your account. Do not share it.

4. Acceptable use and your responsibility

We support the lawful, private use of the internet. You alone are responsible for what you do through the service and for ensuring that your use complies with every law that applies to you.

Because we are logless, we do not monitor, inspect, or keep records of your traffic. This is a privacy feature, not permission to break the law. You, not SmokeVPN, are accountable for your conduct.

5. Prohibited uses

While we defend privacy without compromise, we reject illegal activity just as firmly. You may not use SmokeVPN for any unlawful, harmful, or abusive purpose. Prohibited uses include, without limitation:

• Child sexual abuse material (CSAM) or any sexual content involving minors. Zero tolerance.
• Terrorism, violent extremism, or inciting, planning, or facilitating violence against people.
• Human trafficking, exploitation, stalking, harassment, or threats to others.
• Distributing malware, ransomware, or viruses; hacking, unauthorized access, credential theft, denial-of-service attacks, or operating botnets.
• Fraud, phishing, scams, identity theft, money laundering, or other financial crime.
• Sending spam or bulk unsolicited messages.
• Any activity that infringes the rights of others or is otherwise illegal in your jurisdiction or in the jurisdictions where our infrastructure operates.
• Abusing, overloading, attacking, or attempting to gain unauthorized access to our infrastructure; circumventing account or device limits; or reselling the service without our written permission.

6. Enforcement

If we become aware that an account is being used for any prohibited purpose, we may suspend or terminate it immediately, without prior notice and without a refund. We will not knowingly assist illegal activity, and we will comply with valid legal process. By design, however, we hold very little data (see our Privacy Policy), so there is usually little we are able to provide.

7. Payments and refunds

Subscriptions are prepaid and paid in cryptocurrency through a third-party payment provider. Access is granted for the period you pay for. All sales are final: we do not offer refunds. If a payment cannot be verified, access may be withheld.

8. No warranty

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, error-free, or that any particular website, application, or region will be reachable. You use the service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, SmokeVPN and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or relating to your use of, or inability to use, the service. This includes any loss caused by your own conduct or the conduct of other users. To the maximum extent permitted by law, our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.

10. Your conduct and indemnification

SmokeVPN is a neutral conduit and does not control or monitor what users do. You are solely responsible for your activity. You agree to indemnify and hold harmless SmokeVPN and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the service or your violation of these Terms or any law.

11. Changes

We may update the service or these Terms. Material changes take effect when posted on this page; continued use after a change means you accept it. The "last updated" date above shows the current version.

12. Termination

You may stop using the service at any time. We may suspend or end the service, or your access to it, as described in these Terms.

13. Governing law

These Terms are governed by applicable law. Any dispute will be subject to the courts having jurisdiction over the operator, to the extent permitted by law.
